In some states, people suspected of drunk driving are only required to submit to one blood alcohol content (BAC) test, which will provide results for how much alcohol is present in their system at that time. However, other states require the police officer or arresting officer to provide evidence that supports the claim that the person was intoxicated when they were driving.  

This could include proof like slurred speech, inability-to-follow instructions, and alcohol on their breath, among other things.
